PHILADELPHIA -- A settlement was reached Tuesday in an emotional malpractice case.Rosalyn Patterson delivered her baby by Cesarean section and now she is unable to care for herself.A jury had been empanelled and opening statements had begun when Hahnemann Hospital agreed to settle a lawsuit brought by Patterson's family.
"She can't walk, she can't talk, she can't do anything by herself," said Patterson's husband, Victor Walthour.Patterson's family and attorney said she was a healthy 32-year-old woman in labor with her fourth child when she walked to Hahnemann Hospital. She was taken home on a stretcher three years ago. Now, Patterson's husband has reached a settlement with doctors, nurses, Hahnemann Hospital and its parent company Tenet Health Systems."Maybe we can get some help for Rosalyn," Walthour said.Attorneys for both sides had been silenced by gag orders. The jury only heard the opening statement from the attorney for Patterson's family, Rhonda Hill Wilson. Wilson argued that a series of mistakes caused catastrophic harm to Patterson.Wilson said that Patterson was in labor for 27 hours before the decision was made to perform a C-section. Wilson said Patterson bled from an incision that was cut too deep and she suffered a severe blood loss. Wilson said Patterson lost half the blood in her body and actually died twice.Wilson claimed that the staff involved in the case doctored charts to cover the mistakes. She said that the lawsuit would lead to changes at Hahnemann Hospital."Hopefully, a result of this, these companies will take a look at that and put the emphasis on patient safety," Wilson.Details of the settlement were not made public. However, NBC 10 was told there is no admission of guilt or wrongdoing.
