Mall Store Busted For Selling Bongs

A popular store at area local malls is in hot water for allegedly selling water pipes and other items police believe promote marijuana use.

Police have filed charges against Spencer Gifts' President and CEO Steven Silverstein, 46, of Summit, N.J., and Oxford Valley Mall Spencer store manager, Wayne Oles, 53, of Philadelphia.

Spencer's has 600 mall locations throughout the United States and Canada.

Both men are charged with selling drug paraphernalia and criminal conspiracy at two local malls.

Police seized water bongs, or hookahs, from the store in the Oxford Valley Mall in Langhorne, Middletown Township, Bucks County, in September, along with many other items with drug-related messages, such as T-shirts and shot glasses.

Following that seizure, Bensalem Township Police seized hookahs from the Spencer's in the Neshaminy Mall.

Police said Silverstein said it was ultimately his decision what items Spencer's carried.

According to an affidavit obtained by NBC 10, a police detective was inside a Spencer's store in Oxford Valley Mall in Langhorne, Bucks County, when he observed "several items which depicted marijuana."

These items included "T-shirts, hats, posters, key chains, leis of Marijuana leafs, stationary, incense, headbands, boxer shorts, candles, ice cube trays, coasters, dishes, glasses, phone books, chess sets, cookie cutters and other items," says the affidavit.

The detective also found hookahs, or water pipes, for sale, and subsequently bought several from a store clerk.

In a press statement, police said they interviewed Spencer Gifts' CEO Silverstein, who they said described his company as "part of a cultural phenomenon" that sells to a young clientele in a "lifestyle or age of rebellion."

Spencer Gifts has faced legal actions for its merchandise before.

The company was charged in October 2004 with breaking a Mississippi law that prohibits selling sexual devices.

There was also controversy in Colorado in June 2004 when a 9-year-old boy bought an inflatable sex toy.
